GENERAL TERMS AND CONDITIONS
These general terms and conditions constitute the terms and conditions governing the use, by users who have registered in the manner indicated in art. 2 (hereinafter, "Registered Users").
These General Conditions are applicable to all Services provided jointly by Media Trade Company S.r.l.,
with registered office in Via Giovanni Battista Pirelli, 9, Milan, VAT and Tax Code 08046610963 ("Media Trade") and the association IPS Academy (IPSA), with registered office in Viale Papiniano, 41, Milan, VAT and Tax Code 08668730966 ("IPSA").

1. Services
1.1 The Services allow Registered Users to enter, store, publish, disseminate, communicate information, texts, images, links to external sites (hereinafter, "User Generated Content" or "UGC"), within special virtual spaces, technically designed to accommodate them;
1.2 The Registered User expressly acknowledges that the Services, Materials and software necessary to provide the Services (of
hereinafter referred to as "Software") are intended for personal use only and are not.

2. Privacy
2.1 In order to use the Services, it is necessary to register, after reading the Privacy Policy. (by hereinafter, "Privacy Policy"), the data requested and expressly accept these General Conditions.
The truthfulness, correctness and accuracy of such data is the exclusive responsibility of the Registered User, who, assuming to
it bears all responsibility, guarantees the truthfulness of all the personal data provided during the registration process and it will undertakes to communicate any updates to the same. The Registered User acknowledges that the failure to confer of truthful and correct registration data may not allow for password recovery and/or deletion account.
2.2 All personal data provided by Registered Users during registration and use of the Services will be processed by Media Trade, the sole data controller, in accordance with EU Regulation 2016/679 of 27 April 2016 (hereinafter, "Privacy Policy") and as indicated in the Privacy Policy.
2.3 The Registered User acknowledges that any personal data of third parties may only be provided if the User Registered has acquired the express and informed consent of third parties to the processing of such personal data; consent that for minors must be expressed by those who exercise parental responsibility. The Registered User expressly recognizes and agrees to be the only responsible party with regard to compliance with the Regulations Privacy in the context of the communication to Media Trade of the above mentioned personal data, also committing itself to hold and hold Media Trade harmless with reference to any cost, charge, sanction and expense arising from the violation of the Privacy Policy in the context of the use of the Services. The Registered User expressly acknowledges and accepts that the violation of the above mentioned provisions is punishable under Articles. 166 ff. of Legislative Decree no. 196/2003 and subsequent amendments and additions (below, "Privacy Code"), as well as in accordance with the Privacy Regulations.
2.4 By registering (and as further specified in the Privacy Policy) the User declares that he/she is adult.

2.5 The User (even if not registered), expressly recognizes and accepts that, even during the navigation of the Site, you may receive on your own end small text files (so-called cookies), which may be stored for be retransmitted to the same Site on the next visit of the same user and/or cookies set by a website different from the Site. For more information about cookies, please refer to the Cookie Policy of the Site.

3. Use of authentication credentials and Nick
3.1 The authentication credentials referred to in Articles 2 and 3 above and the Nick are personal and cannot be transferred.
The Registered User is obliged to keep them with the utmost diligence and to keep them confidential in order to prevent the use of the.
Services by unauthorized third parties. The possible knowledge of the same by third parties, in fact, would allow to the latter to use the Services on your behalf.
3.2 The Registered User shall be responsible for any use, made by authorized or unauthorized third parties, of the credentials, as well as any damage caused to IPSA, Media Trade and/or third parties, as a result of the failure to compliance with the above, pledging from now on to indemnify and hold IPSA and Media Trade harmless from any and all any claim, including compensation for damages, arising, directly or indirectly, from the aforementioned use orabuse.

4. Notes
4.1 Registered Users acknowledge and accept that the UGCs entered by them in the spaces above unless is otherwise indicated, are automatically published on line and, therefore, will be available, accessible and visible, for all the duration of their stay on line to any user, even if not registered to the Services, who can access them and view them via fixed and mobile networks.
5.2 Registered Users acknowledge and accept that some UGCs entered by them may be commented on, as well as reproduced and distributed also on sites owned by third parties and in such cases, even if removed by Registered Users themselves, by Media Trade or IPSA, may continue to appear on other Internet sites or temporarily via search engine cache copies. Media Trade and IPSA, also due to the intrinsic nature of the Internet, do not provide any warranty and assumes no responsibility against the risk of deterioration or piracy that may result in subject to the UGC or part of them and/or misuse by third parties.

5. Warranties and Liability

5.1 The Registered User undertakes to use the Services in accordance with the applicable legal provisions, customs, and regulations. customs, the rules of diligence and in any case without infringing the rights of third parties. Registered Users, in particular,  acknowledge that it is forbidden to insert, publish and/or transmit (or allow others to do so) UGC:
a) of an offensive, insulting, defamatory, libelous, discriminatory, pornographic, vulgar, obscene nature, child pornography, blasphemous and in any way not in accordance with the principles of public order and good order custom or morality or that may cause any damage or prejudice to third parties, and in particular to minors; that violate current legal regulations
(b) harassing the public or private peace or offending or damaging, directly or indirectly, anyone or he encourage third parties to engage in unlawful and/or criminal conduct liable to criminal or civil liability;

c) that contain viruses or other programs designed to damage or interfere with the proper functioning of the Services, cause an unreasonable overload of activities of the technological infrastructure and the Media servers Trade and IPSA or intercept or appropriate operating systems, data or personal information or violate, subtract or suppress computer or telematic correspondence to third parties;
d) containing advertising or any other form of unsolicited and unwanted solicitation.
5.2 the registered user expressly acknowledges and accepts that works protected by intellectual property rights may
be entered into the spaces made available to it only if the Registered User has acquired, from the holder of the copyright and any related rights, rights of use and, therefore, only with the permission of the right holder and with the obligation to mention the source and existence of the permit. The Registered User, therefore, guarantees the origin and the originality of the UGCs entered through the Services, in the aforementioned spaces, and agrees not to copy, reproduce, process, alter, modify, transcribe, duplicate, communicate, distribute, exchange or otherwise disclose or make available to the public any material protected by law copyright without the express permission of the third party owners of intellectual property rights. It is recalled that the infringement of these provisions is punishable under Articles 171 ff. of the Copyright Law No. 633/41 (hereinafter, "LdA") and that, in particular, the reproduction and making available to the public (also through file sharing or "file- sharing") of works protected by copyright without the authorization of the owner of the rights is prohibited and to the aforementioned Violations are subject to the sanctions, including criminal ones, provided for by the LdA.
5.3 Without prejudice to the above, the Registered User agrees that all content shared by him/her will be screened by IPSA or by whom for it and that any content may be rejected.

6. Disabling and deleting UGC
6.1 It is understood that i) in the event of violation by Registered Users of the provisions and warranties set forth in the article 6, paragraphs 1 and 2 above, or, ii) in any case, if Media Trade or IPSA becomes aware of the following, in any case way (including by means of reports, warnings, claims, claims and/or demands of third parties in connection with the submitted UGCs by the Registered Users) that the Registered Users have used the Services in a manner different from that provided herein General Terms and Conditions; iii) or if Media Trade or IPSA, in its sole discretion, believes that the UGC may be a cause of damage to third parties or to oneself; or iv) in the event of a request by competent authorities; or v) if the e-mail address used for registration or in any case the data provided is not true, current or available to the User Registered, Media Trade or IPSA may, at its discretion and without prior notice, take any initiative which it deems appropriate and/or necessary, including temporary or permanent removal or disabling of UCGs, temporary or permanent, access to the Services.

7. Variations of Services
The use of the Services necessarily implies the acceptance of these General Conditions. The Registered User is aware that these General Terms and Conditions may be modified at any time, by means of the publication, online, of the new version. Media Trade or IPSA will in any case undertake to inform the User of the following Recorded of any changes to the contractual conditions of the Services.

8. Duration, withdrawal
8.1 The Services are provided indefinitely and free of charge, excluding Internet connectivity costs. 82 The Registered User may exercise without penalty the right of withdrawal even after the term of as per art. 64 of the Consumer Code, giving notice to the address referred to in art. 9.1 below.
8.3 IPSA and Media Trade will have the right to withdraw from this Agreement at any time by means of written communication sent to the e-mail address of the Registered User with 15 days notice.
8.4 The dissolution and/or termination, for any reason whatsoever, of this Agreement will result in the termination of all the Services it being understood that the Registered User will continue to be responsible for the UGC entered and operations performed through the Services even after their dissolution and/or termination.

10. Applicable law and jurisdiction
These General Conditions are governed by Italian law. For any dispute related to this The Court of residence or elective domicile of the Registered User shall have jurisdiction over the contract. For anything not provided for in the these General Terms and Conditions will be applicable to the relevant legal provisions, including the rules on contracts to
distance referred to in Articles. 50 et seq. of the Consumer Code.
